Terms of Service

The following are the terms and conditions for the use of the CONAKAT service (the Service), including website, information services, directories, da tabases, advertising, email and other services. The CONAKAT service is owned and run by Tuhin Imam (the Site Owner). The Service is offered to individua ls and companies in England and Wales (the User). BY USING THE SERVICE THE USER STATES THAT THEY ARE ELIGIBLE TO USE THE SERVICE AND THAT THEY AGREE TO B E BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE SERVICE (TOS).

The Service is offered to the User conditioned that the User accepts without modification the terms, conditions and notices contained herein.

Account Holding Users

Some Users who use the directory, advertising, website and other services have accounts that enable them to put information and other material on the Service or to communicate with other Users through the Service, these Users should refer to anly additional "Account Policies" and "Account Charges" that apply to their accounts

Privacy Policy

The provisions described in our Privacy Policy Statement should be read as an integral part of these terms of service.

User Conduct

The User warrants to the Site Owner that they will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions and n otices. The User agrees that:

• They will not harvest or otherwise collect any information about others, including email addresses, telephone numbers or other details without their consent.
• They will not interfere with or disrupt networks connected to the Service or violate the regulations, policies or procedures of such networks.
• They will not attempt to gain unauthorised access to the Service, other accounts, personal details of other Users, computer systems connected to the Service, through password mining or any other means.
• Any material the User posts on the Service or communicates to other Users through the Service will be relevant to that particular portion of the Serv ice.
• The User takes full responsibility for any legal consequences whatsoever that arises as a consequence of material posted on the Service by the User o r transmitted by the user through the Service and indemnifies the Site Owner of all legal costs or damages caused by the users material.
• They will not tranmit any material that contains viruses, trojan horses, worms, time bombs, cancelbots or any other harmful or deleterious programmes onto the Service or through the Service.
• They will not put onto the Service or transmit through the Service any material that is protected by intellectual property laws, rights of privacy or publicity or any other applicabale law unless the User owns or control the rights hereto or has received all necessary consents.
• They will not create a false identity for the purpose of misleading the Site Owner or other Users.

The Site Owner has no obligation to monitor any User's use of the Service or retain the content of any user or User session. However, the Site Owner r eserves the right at all times to monitor, review, retain, and/or disclose any information as necessary to safisfy any applicable law, regulation, legal process or government request.

Participation in Promotions of Advertisers

Any dealings with Advertisers on the Service or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the Advertisers or other third party. The Site Owner shall not be responsible or liable for any part of any such dealings or promotions.

Proprietory Rights to Content

The User achnowledges that content including but not limited to text, software, music sound, photographs, video, graphics or other material contained in either sponsor advertisements or electronically ditributed, commercially produced information, presented to you by the Site Owner, advertisers on the Service or other content providers is protected by copyrights, trademarks, service marks, patents or other proprietory rights and laws. You may make a co py of this content for your personal, non-commercial use only, provided that you keep all copyright and other proprietory notices intact. You may not mod ify, copy, reproduce, republish, upload, post, transmit, or districbute in any wany content available through the Service without the prior formal permis sion of the copyright owners.

Disclaimers/Limitation of Liability

The information and services included in or available through the Service may include inaccuracies or typographical errors. Changes are periodically m ade to the information herein. The Site Owner and/or its respective suppliers my make improvements and/or changes in the Service at any time. The Site Ow ner does not represent or warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available, are free of viruses or other harmful components. The Owner does not warrant or represent that the use or results of the use of the Service or the materials made available as part of the Service will be correct, accurate, timely or otherwise reliable. The User specifically agrees that the Site Owner shall not be responsible for unauthorised access or alteration of any or the Users material transmitted through the Service or hosted on the Service. The User specifically agrees that the Site Owner is not responsible or liable for any threatening defamatory, obscene, offensive or ille gal content of any third party or any infringement of anothers rights including intellectual property rights. You specifically agree that the Site Owner is not responsible for any content sent and/or included in the Service by any third party.

THE SITE OWNER AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF TH E SERVICE FOR ANY PURPOSE. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE SITE OWNER AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTE ES AND CONDITIONS OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

UNDER NO CIRCUMSTANCES SHALL THE SITE OWNER AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL CONSEQUENTIAL DAMAG ES OR ANY DAMAGES WHATSOEVER INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, USE OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICE OR RELATED WEB SITES, WITH THE DELAY OR INABILITY TO USE THE SERVICE OR RELATED WEB SITES, THE PROVISION OF OR FAILURE TO P ROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICE OR OTHERWISE ARISING OUT OF THE US E OF THE SERVICE WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF THE SITE OWNER OR ANY OF ITS SUPPLIERS HAS BEEN ADVI SED OF THE POSSIBILITY OF DAMAGES.

IF YOU ARE DISSATSFIED WITH ANY PORTION OF THE SERVICE, OR ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVI CE.

THE LINKS INCLUDED WITH THE SERVICE MAY LET YOU LEAVE THE SERVICE WEB SITES TO "LINKED SITES". THE LINKED SITES ARE NOT UNDER THE CONTROL OF THE SITE OWNER AND THE SITE OWNER IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE OR ANY LINK CONTAINED IN A LINKED SITE, OR ANY CHANGES OR PDATES TO SUCH SITES. THE SITE OWNER IS NOT RESPONSIBLE FOR WEBCASTING OR ANY OTHER FORM OF TRANSMISSION RECEIVED FROM ANY LINKED SITE. Indemnification

The User agress to indemnify the Site Owner, it parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand or damage, including reasonable legal fees, asserted by any third pary due to or arising out or the Users use of the Service.

Termination

The Site Owner my terminate the Users access to any part of the Service and any related services at any time without cause, or without notice, effecti ve immediately, for any reason whatsoever.

Modifications to Terms of Service

The Site Owner reserves the right to change the TOS at any time and to notify you by posting an updated version of the TOS on at this web address. The User is responsible for regularly reviewing the TOS. Continued use of the Service after any such change shall constitute the User's consent to such chan ges.

General

This agreement is governed by the laws of England and Wales. Use of the Service is unauthorised in any jusidiction that does not give effect to all pr ovisions of these terms and conditions, including without limitation, this paragraph. The User agree that no joint venture, partnership, employment, or a gency relationship exists between the User and the Site Owner as a result of this agreement or use of the Service. The Site Owner's performance of this a greemet is subject to existing laws and legal process, and nothing contianed in this agreement is in derogatin of the Site Owner's right to comply with g overnmental, court and police enforcement requests or requirements relating to your use of the Service or information provided to or gathered by the Site Owner with respect to such use. If any part of the agreement is determined to be invalid or unenforceable persuant to applicable law including, then the reaminder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and the Site Owner with respect to the Service (excluding Account Holder accounts which may be subject to specific Account Terms and Account Charges)and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the Site Owner and the User with r espect to the Service. A printed form of this agreement and of any nitice given in electronic form shall be admissible in judicial or administrative proc eedings based upon or relating to this agreement to the same extent and subject to the same condition as other business documents and records originally generated and maintained in printed form. The User and the Site Owner agree that any cause of actions arising out of or related to this Service must comm ence within one year after the cause of action arose; otherwise, such cause of action is permanently barred. The section titles in the TOS are solely use d for the convenience of the parties and have no legal or contractual significance.
